What Does this Warranty Cover?
Subject to the exclusions contained below, ScriptFOLIO, Limited Liability Company warrants its leather products to be free from defects in materials and workmanship with the exception of ‘normal’ range markings and under normal consumer usage for the period(s) outlined below. This limited warranty is a consumer’s exclusive remedy, and applies as follows to new Products and Accessories, purchased by the original consumer, which are accompanied by this written warranty and receipt of purchase:
PRODUCTS COVERED
Manufactured Leather Products, their original parts/accessories at time of manufacturing, adhesives, and any repairs or replacements made by manufacturer.
LENGTH OF COVERAGE
• Lifetime Coverage against manufactured defects which includes and is limited to sewn thread, all leather parts, and adhesives.
• 6 Months from date of purchase by consumer purchaser of the product for all embossing and add-on accessories.
"’Normal’ Range Markings” Defined:
ScriptFOLIO products are enhanced with the “natural” beauty inherent to leather. Each hide features its own wrinkles, scars, and markings from life on the open range, making it naturally unique and more desirable. These marking may consist of, but are not limited to, barb wire scars, scratches, wrinkles, and cattle brands. Some of these markings are further enhanced by the addition of dyes and pigments during the manufacturing process. ScriptFOLIO makes no effort to hide such ‘flaws’. As a result, ScriptFOLIO products may seem ‘rustic’ to those not familiar with the “normal” nature of leather hide.
"Original Parts" Defined:
Original parts include all leather parts, snaps, rivets, ‘GripClip”, pockets, linings, and adhesives created/added at time of manufacturing.
"Accessories" Defined:
Accessories are any enhancements other than those features standard with the original product offered. These may include but are not limited to, belt clips, grommets, straps, and embossing. Such accessories added on as a custom addition to the original product are also considered "Add-On" accessories.
What is not covered? (Exclusions)
Ornamental Decorations. Ornamental decorations such as emblems, graphics, rhinestones, jewels, gemstones and their settings, tooling, and other decorative elements, are excluded from coverage.
Abuse & Misuse. Defects or damage that result from: (a) improper operation, storage, misuse or abuse, accident or neglect, such as physical damage (cracks, scratches, slits, splits, rips, etc.) to the surface of the product or its accessories, resulting from misuse; (b) contact with liquid, water, rain, extreme humidity or heavy perspiration, sand, dirt or the like, extreme heat, or food; (c) subjecting the Product or Accessory to abnormal usage or conditions; or (d) other acts which are not the fault of ScriptFOLIO, are excluded from coverage.
Unauthorized Modification. Defects or damages resulting from service, testing, adjustment, installation, maintenance, alteration, including without limitation, physical changes, or modification in any way by someone other than ScriptFOLIO, LLC or its authorized service center, are excluded from coverage.
Altered Products. Products or Accessories that show evidence of tampering are excluded from coverage.
Who is covered?
This warranty extends only to the first consumer purchaser, and is not transferable.
What will ScriptFOLIO Do?
ScriptFOLIO, at its option, will at no charge (with the exception of shipping and handling) repair, replace or refund the purchase price of any Products and/or Accessories that does not conform to this warranty. We may use functionally equivalent reconditioned or refurbished or pre-owned or new Products, Accessories, or parts. Cost of shipping and handling, both to and from the manufacturer, ScriptFOLIO, will be the responsibility of the consumer and may be invoiced prior to the receipt and or return of repaired item.
How to Obtain Warranty Service or Other Information?
To obtain service or information, please email: ScriptFOLIO Services at info@scriptfolio.net and write in detail the problems or concerns you may be experiencing and with what product. You may also contact via standard mail at: ScriptFOLIO Services; PO Box 711; Oklahoma City, OK 73101-0711. Warranty Service will only be provided after a written detailed concern is received. No Warranty Service repair will be discussed on initiation over the telephone. After the original written detailed concern is received and acknowledged, follow-up communication may be done via email, in writing, or by telephone. This is to prevent miscommunication and insure all parties involved are on the 'same page' regarding every concern.
You will receive instructions on how to ship the Products and/or Accessories at your expense, to the ScriptFOLIO Authorized Repair Center. To obtain service, you must include: (a) a copy of your receipt, bill of sale or other comparable proof of purchase; (b) a written description of the problem; (c) your name, mailing address, and telephone number. Shipping and Handling charges may apply.
What Other Limitations Are There?
ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL BE LIMITED TO THE DURATION OF THIS WARRANTY, OTHERWISE THE REPAIR, REPLACEMENT, OR REFUND AS PROVIDED UNDER THIS EXPRESS WARRANTY IS THE EXCLUSIVE REMEDY OF THE CONSUMER, AND IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OF IMPLIED. IN NO EVENT SHALL ScriptFOLIO BE LIABLE, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE) FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT AND/OR ACCESSORY, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR APPLICATIONS OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE PRODUCTS AND /OR ACCESSORIES TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.
Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, or limitation on the length of an implied warranty, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state or from one jurisdiction to another. © ScriptFOLIO, LLC. 2007, 2008, and 2009.
In the event ScriptFOLIO, LLC should ever go out of business, all warranties and services shall become null and void at that time, with the exception of repairs, replacements, and or refunds ‘in process’ at time of business closure.
